Non Legislative Powers are the powers that congress has that do not involve law making. Some of these are held by both houses, and some by only the House or the Senate.

Powers Common to Both Houses:

  • Can propose amendments
  • Call a convention to propose an amendment
  • Conduct investigations
  • Call witnesses
  • The House can vote to impeach a government official
    • The trial for this official is then held in the Senate
  • If the vice president is vacant they have to confirm a choice by majority vote

Powers of the House

  • Choosing president if no candidate wins the majority of the electoral college votes

Powers of the Senate

  • Choose vice president if no candidate gets a majority of the electoral college votes
  • Approve treaties that the president may negotiate
  • Provide advice and consent on executive and judicial branch appointments made by the president
